An Ordinance Establishing Customer Utility Deposits for the City of Carmi, Illinois and Revoking Ordinance No. 1002 and 1253
Be it ordained by the Mayor and City Council of Carmi, Illinois:
Article 1. Utility Deposits for Service
The City of Carmi, Illinois and Carmi Light and Water, is authorized to make customer utility deposit charges as follows:
Customer utility deposit for initial residential combined electric and water services shall be $300.
Customer utility deposit for initial residential water only service shall be $50.
Customer utility deposit for initial commercial combined electric and water service shall be $400. Customers that qualify for an E3 or E4 electric rate shall pay a deposit of not less than $500 and not more than $1500 as determined by Carmi Light and Water.
Customer utility deposit for initial commercial water only service shall not be less than $100 or more than $1500 as determined by Carmi Light and Water.
Article 2. Return of Deposits
Customers who have made the above-mentioned deposits, or who have made deposits required under previous ordinances, shall be refunded the deposit actually made by them; provided that such customer has been current in paying utility changes for a term of 1 year prior to the time such refund is made. Current payment shall mean payments made in accordance with statements made and mailed to such customer. Failure of the US Postal Service to deliver statements does not release the customer from charges.
Article 3. Ordinance No. 1002 and Ordinance No. 1253 are hereby revoked. All Ordinances in conflict with the above Ordinance are hereby repealed.
This Ordinance shall be effective on November 1, 2024 following passage and publication.
